ACCEPTANCE OF THE TERMS OF SERVICE

THE FOLLOWING TERMS AND CONDITIONS (“TERMS”) APPLY TO YOUR USE OF THE Cradle of Sins VR game AND Other U24 SOLUTIONS AFFILIATES (“U24”, “WE” “US” OR “OUR”), INCLUDING ANY CONTENT, FUNCTIONALITY, PRODUCTS, AND SERVICES OFFERED ON OR THROUGH SUCH WEBSITES (COLLECTIVELY, THE “WEBSITE”), WHETHER AS A GUEST OR A REGISTERED USER. THESE TERMS ALSO APPLY TO YOUR USE OF OTHER.

BY USING THE SERVICES, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE TERMS OF SERVICE. IF YOU DO NOT WANT TO AGREE TO THESE TERMS OF SERVICE, YOU MUST NOT USE THE SERVICES. IN PARTICULAR, WE WANT TO HIGHLIGHT SOME IMPORTANT TERMS, POLICIES, AND PROCEDURES IN THESE TERMS. BY ACCEPTING THESE TERMS:

TO ENTER INTO THE CONTRACT CREATED BY THESE TERMS, YOU MUST BE AN ADULT OF THE LEGAL AGE OF MAJORITY IN YOUR COUNTRY OF RESIDENCE.  YOU ARE LEGALLY AND FINANCIALLY RESPONSIBLE FOR ALL ACTIONS USING OR ACCESSING OUR SOFTWARE, INCLUDING THE ACTIONS OF ANYONE YOU ALLOW TO ACCESS TO YOUR ACCOUNT. YOU AFFIRM THAT YOU HAVE REACHED THE LEGAL AGE OF MAJORITY, UNDERSTAND AND ACCEPT THESE TERMS (INCLUDING ITS DISPUTE RESOLUTION TERMS).  IF YOU ARE UNDER THE LEGAL AGE OF MAJORITY, YOUR PARENT OR LEGAL GUARDIAN MUST CONSENT TO THESE TERMS.

Privacy Notice which governs your use of the Services, to understand our practices.

Information We Collect

We only collect, use, share, store, or otherwise process your personal information when we have an appropriate basis. For example, we may process your personal information as necessary to provide services that are subject to terms you have accepted, such as our end user license agreements (like competing in Cradle of Sins tournaments) or service terms and conditions (such as the Terms of Service). We may process your personal information when necessary to comply with legal obligations or for purposes of pursuing legitimate interests, if doing so is consistent with your rights and appropriate to the context, such as providing services, addressing game performance, fixing bugs, performing internal analytics, and conducting reasonable monitoring of your use of our services to prevent misuse of the U24 services and fraud. Additionally, we may, in certain cases, ask you for your consent for certain processing of your personal information.

We generally collect information in three ways: (1) you voluntarily provide information to us, such as by creating an account, making purchases, or signing up for email alerts, (2) we collect information automatically, such as through cookies or our games and other software.

Information You Provide

You may provide your personal information to us when you choose to use the U24 services. Because we change our offerings and features from time to time, the options you have to provide us with information also may change. The following are some examples of situations in which you may provide information to us:

  • Creating an account in Cradle of Sins Launcher;
  • Licensing and downloading our games
  • Purchasing something from us or otherwise engaging in a transaction with us;
  • Entering online competitions or registering for or participating in special events;
  • Entering contests or sweepstakes, participating in any of our promotions, or accepting any prizes from us;
  • Signing up for email alerts or subscribing to receive other information from us;
  • Completing a survey;
  • Contacting us for any reason, such as by email, including for technical support or customer service.

The personal information we collect from you will vary depending on the U24 services you are using and how you interact with them. The information you provide to us may include your name, your display name, and your email address(es). If you choose to make a purchase, we will collect payment card information such as your card’s payment account number and expiration date. Sometimes we ask for your phone number, your postal address, your billing address, your date of birth, and your gender.

Information We Collect Automatically

We collect some information automatically when you visit the U24 services. If a combination of information that we collect does identify you as an individual, we will treat the combined information as personal information. We typically aggregate the data that we collect automatically and use it in statistical form to determine trends among groups of users, rather than using it to identify individuals.

We collect information automatically through technologies such as web browsers, cookies, log files, web beacons, and our back-end servers collect usage data transmitted from our games and other software. We use the information for purposes such as modifying or improving features, managing advertising, addressing technical issues, preventing fraud or misuse of our services, and conducting data analytics. Technical information about your computer, device, hardware, or software you use to access the Internet or our services, such as IP address or other transactional or identifier information for your device (such as device make and model, information about device operating systems and browsers, or other device or system related specifications);

  • Usage information and statistics about your interaction with the U24 services, which may include the URLs of our websites that you have visited, URLs of referring and exiting pages, page views, time spent on a page, number of clicks, platform type, the application you used or the game you played, how long you used or played it and when, and other usage statistics;
  • Crash reports, which may be automatically generated when a game or application crashes and includes information about your system and the crash;
  • Information that facilitates a safer and more personalised experience, such as your display name or other user identification provided in connection with your application use or game play, saved preferences, game progress, and device identifiers or usage information for authentication and fraud prevention purposes;
  • The location of your device, such as may be derived from your device’s IP address.

Please note that if certain features on the U24 services are provided by third parties, those third parties may also use automated means of data collection and may record information about your use of the U24 services or others’ websites over time. These features are subject to those third parties’ privacy notices and policies.

How We Use and Share Information

As a general matter, we use your information to provide the services, experiences, merchandise, or information you request. We also may use your information for the following purposes:

  • To support our legitimate interests, consistent with your rights and preferences, we use personal information:
  • To communicate with you, respond to your requests, or provide you with updates and information;
  • To better understand our users, their interests, and their preferences;
  • To personalise your experience, save your preferences, authenticate our users, and provide similar user-experience features;
  • To develop, deliver, and improve our products, services, and other offerings, some of which may be offered in partnership with other parties;
  • To manage and customise advertisements or promotional offers;
  • To send out news letters to email
  • For security purposes;
  • For internal purposes such as auditing and data analysis.

To provide services that are subject to terms you have accepted, such as enforcing our licenses, agreements, and terms of service, which may include reasonable monitoring to detect and prevent misuse or fraud and to keep our games fair for all users.

How We Protect Personal Information

We maintain appropriate administrative, technical, and physical safeguards to protect your personal information from accidental, unlawful, or unauthorised destruction, loss, alteration, access, disclosure, or use and other unlawful forms of processing. In some cases, your information is accessible when you log into a feature we offer, and in those cases you need to keep your user credentials and password confidential and secure so that your information is protected.

Accessing the Services and Account Security
We may withdraw or amend the Services, and any related service or content, or restrict access (including by means of cancellation, termination, or modification, or suspension of a user account) to all or certain users (including you) without notice and without liability to you in our reasonable discretion. Additionally, due to your geographic location, the Services or some of their features, services, or content may be unavailable to you.  Notwithstanding anything to the contrary herein, we may terminate or suspend access to the Services based on your breach of these Terms.

To access certain Services, you will be asked to provide registration details or other information, and in order to use such resources, all the information you provide must be correct, current, and complete. U24 is not responsible if an account is already created with the email you wish to create it with. From time to time, in order to access the Services or certain games, services, or functionality, we may require some or all users to download updated or additional software. The terms of use of such software may be subject to separate agreement between you and us.

If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential (other than user name), and you must not disclose it to others. You must immediately notify us (via info@u24solutions.com) of any unauthorized use of your user name or password or any other breach of security. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. You may only access the Services through your own account. Users do not own their accounts, and gifting or otherwise transferring of accounts or access keys is prohibited.

We reserve the right to change your display name if we deem it offensive, misleading, potentially infringing the rights of third parties or if you have been inactive for more than a year.

USER CONTRIBUTIONS

The Services contain various forums, networks, and other interactive features that allow you to post, submit, publish, display, or transmit to Cradle of Sins and other users (“Post”) content or materials (“User Contributions”) on or through the Services.

You represent and warrant that you own or otherwise control all of the rights to the User Contributions that you Post at the time of Posting; that the User Contributions are accurate and not fraudulent or deceptive; and that the User Contributions do not violate these Terms or the rights (intellectual property rights or otherwise) of any third party, and will not cause injury to any person or entity. You understand that your User Contributions may be copied by other Services users and discussed on and outside of the Services, and if you do not have the right to submit User Contributions for such use, it may subject you to liability. U24 Solutions takes no responsibility and assumes no liability for any content Posted by you or any third party.

U24 Solutions has the right but not the obligation to monitor and edit or remove any User Contributions. U24 also has the right to terminate your access to all or part of the Services for any or no reason, including without limitation, any violation of these Terms. U24 may exercise these rights at any time, without notice or liability to you or any third party.

 

ONLINE STORE SALES TERMS

The owner of the online store www.cradleofsins.com (hereinafter the Online Store) is Marine Electrical International Ltd

 

Sales terms validity, product- and price information.

Sales terms are valid during purchasing from Online Store

The prices of the products sold in the online store are indicated next to the products. A fee for delivery of the goods is added to the price. All prices of goods sold in the online store are in dollars.

The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when ordering.

Information about the goods is provided in the Online Store directly next to the goods.

 

Placing an order

To order the goods, you must add the desired products to the shopping cart. To place an order, fill in the required data fields and select the appropriate method of product delivery. The screen will then display the amount of the fee, which can be paid securely through the following payment methods:

Visa / Mastercard card payments

NB! When paying with a bank link, be sure to click the “Back to merchant” button on the bank’s page.

Payments are mediated by StripePayment takes place outside the Online Store in a secure environment – when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in the secure environment of Stripe. The seller does not have access to the customer’s bank and credit card details. The agreement enters into force upon receipt of the amount due to the current account of the Online Store.

The owner of the online store is the chief processor of personal data and forwards the personal data necessary for making payments to the authorised processor Stripe.

If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. Delivery costs) will be refunded immediately, but not later than within 14 days of sending the notice.

 

Delivery

Goods will be shipped to the following countries: Worldwide

In order to receive the goods, the buyer has the following options:  Omniva

Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.

Domestic shipments usually arrive at the destination specified by the buyer within 30 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 45 calendar days.

In exceptional cases, the right to deliver the goods within 90 calendar days.

 

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.

NB! Depending on the products, the buyer may not have the right of withdrawal, the corresponding products and services must be listed in such a case and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act.

The right of withdrawal does not apply if the buyer is a legal person.

In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.

If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or have signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.

In order to return the goods, a withdrawal application must be submitted, the form of which can be found here: withdrawal application and send it to the e-mail address info@u24solutions.com no later than within 14 days of receipt of the goods.

It is a good practice to offer our customers free returns, which increases reliability and, through it, sales. Therefore, the next paragraph is for the Merchant who cannot offer a free refund.

The costs of returning the goods shall be borne by the buyer, unless the reason for the return is due to the fact that the product to be returned does not correspond to what was ordered (eg a defective or defective product).

The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.

Upon receipt of the returned goods, the online store shall return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that he has returned the item, whichever is earlier.

If the buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the Online Store, the Online Store does not have to reimburse the consumer for a cost that exceeds the cost related to the usual delivery method.

The online store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.

 

Right to lodge a claim

The online store is liable for non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery of the thing and which becomes apparent within two years from the delivery of the goods to the buyer. unless, during the first six months after delivery of the thing to the buyer, it is presumed that the defect already existed at the time of delivery of the thing. It is the responsibility of the Online Store to rebut the respective presumption.

The buyer has the right to contact the online store within two months at the latest by sending an e-mail to info@u24solutions.com

The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.

The online store shall respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transmits personal data to transport companies in order to deliver the goods.

The online store will send newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish by entering the e-mail address on the website and has announced his / her wish to receive direct mail notifications.

The buyer can cancel the offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

 

Solving arguments

If the buyer has any complaints regarding the Online Store, they must be sent to the e-mail address info@u24solutions.com

If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms of the procedure can be viewed and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint in the commission is free of charge.

The buyer can turn to the European Union Consumer Dispute Resolution Platform.
